Resolutions of Disputes Arise During the Construction Phase: A Comparison of KİK and FIDIC Documents

One of the biggest problems of the construction industry is the problem of disputes. These disputes usually arise between the contractor and the employer after signing the contract and during the construction process and they negatively affect the process. The aim of this research is to study the dispute boards and to determine the deficiencies of the KIK (Public Procurement Law) by comparing the dispute resolution processes defined in the KIK and FIDIC (Federation Internationale Des Ingenieurs Conseils) documents regarding cost, time, and quality criteria. On the KIK side, the laws, used in construction works when the public sector is a party, were included in the study. On the FIDIC side, the Red Book, which is in accordance with the traditional project delivery system that is mainly used by the public sector, is included in this content. In this study, the document analysis method, which is one of the qualitative research methods, was used. With this method, firstly, the Turkish construction legislation and FIDIC documents were analyzed in terms of the dispute resolution process. In the next stage, the comparative analysis of the FIDIC and KIK dispute resolution process, in terms of time, cost, and quality criteria, was made. At the last stage, the sections that need to be developed in accordance with the FIDIC of the KİK were tried to be determined.

Yapım Aşamasında Ortaya Çıkan Uyuşmazlıkların Çözüm Yolları: KİK ve FIDIC Dokümanları Üzerinden Bir Karşılaştırma

İnşaat sektörünün en büyük problemlerinden birisi olan uyuşmazlıklar genellikle sözleşme sonrasında, yapım sürecinde yüklenici ve işveren arasında oluşarak süreci olumsuz yönde etkilemektedir. Bu çalışmanın amacı, inşaat sektöründe yapım aşamasında ortaya çıkan uyuşmazlıkların çözüm yollarından olan uyuşmazlık kurullarının incelenmesi, KİK (Kamu İhale Kanunu) ve FIDIC (Federation Internationale Des Ingenieurs Conseils) dokümanlarında tanımlanan uyuşmazlık çözüm süreçlerinin maliyet, süre ve kalite kriterleri üzerinden karşılaştırılarak KİK’in eksik yönlerinin tespit edilmesidir. Kamunun taraf olduğu yapım işlerinde kullanılan kanunlar ve bu kanunlarla doğrudan ve dolaylı bağlantılı alt dokümanlar çalışma kapsamına alınmıştır. FIDIC tarafında ise kamunun da esas olarak kullandığı geleneksel proje teslim sistemine uygun olan Kırmızı Kitap bu kapsama dahil edilmiştir. Bu araştırmada, nitel araştırma yöntemlerinden birisi olan doküman analizi yöntemi kullanılmıştır. Bu yöntemle ilk aşamada Türk yapı mevzuatı ve FIDIC dokümanları uyuşmazlık çözüm süreci yönü ile analiz edilmiştir. Sonraki aşamada FIDIC ve KİK uyuşmazlık çözüm sürecinin süre, maliyet ve kalite kriterleri yönünden karşılaştırmalı analizi yapılmıştır. Son aşamada da KİK’in FIDIC’e göre eksik kaldığı yerler tespit edilmeye çalışılmıştır.
